The regulation of the game in question

Published by Linda George , 22 July 2022

The approval and implementation of the latest Royal Decree, approved on November 3, 2020, affecting the advertising of the game was a controversial issue. A much debated issue and that many saw it as a way to put a personal stamp of the new minister who has just occupied the Ministry of Consumption portfolio.

A short time earlier, the industry itself had put on the table compliance with stricter rules on advertising and responsible gambling. And it is that this is a very sensitive issue and that worries society, governments and the gaming operators themselves, including betting houses and online casinos New Zealand . In Royal Decree 958/2020, of November 3, among other issues, advertisements are prohibited in almost the entire time slot, allowing their broadcast between 1:00 am and 5:00 am.

The New Zealand Digital Gaming Association , which encompasses the majority of New Zealand online gambling operators, filed a contentious-administrative appeal against Royal Decree 958/2020, of November 3 , of commercial communications of gaming activities at the beginning of the year 2021. Following this appeal and after assessing the issue, the Supreme Court has raised a question of unconstitutionality to the Constitutional Court New Zealand for a ruling.

The Supreme Court will raise the unconstitutionality of the article on advertising of the Gambling Law to the TC

In the car that will be elvado, it is quoted: "The doubt of constitutionality arises in view of the terms in which art. 7.2 of Law 13/2011 refers to the regulatory norm to establish the conditions and limits in which the advertising, sponsorship, promotion or any other form of commercial communication of gambling activities by operators must be carried out, due to its possible contradiction with the principle of reservation of law contained in art. 53.1 EC in relation to freedom of enterprise.”

Which is commented from Jdigital

From Jdigital they have shown their satisfaction with this decision and it has reinforced the step they took at the time. Also, from the New Zealand association, they commented that “the current scenario makes it more necessary than ever” that the gaming regulator New Zealand and the Ministry of Consumer Affairs "open a window of dialogue with the online gaming ecosystem to study fair legislative avenues and proportionate to the reality of the sector and do not harm operators and related industries".

The issue surely goes on for a long time seeing the times that justice is taken, but be that as it may, what is clear is that in a regulated gambling guidelines such as the New Zealand, these issues have to be dealt with and an agreement reached. In such a sensitive issue, it is necessary to be very careful and watch out for the players, something that is clearly happening currently, although it seems fair to give a margin to legal gambling so that illegal gambling is not an option and grows in the country. Sitting at a table and reaching agreements have always been the greatest advances.
